A Certificate of Compliance serves as CRA’s authorization under Section 116 of the Income Tax Act, confirming you satisfied your estimated tax obligations on the Canadian property disposition. This clearance document prevents the 25% to 50% withholding that buyers must otherwise remit to CRA from your gross sale proceeds.

All non-resident sales of taxable Canadian property require clearance certificates, including residential homes, commercial buildings, rental properties, and vacant land in Mississauga. The buyer faces personal liability for withholding and remitting taxes if you fail to provide this certificate before closing.

Form T2062 applications require your original purchase agreement, current sale agreement, proof of capital improvements, legal fees, real estate commissions, and property tax statements. CRA also requires your adjusted cost base calculation and supporting receipts for all deductible expenses claimed against the disposition.

Form T2062A applies to dispositions of taxable Canadian property other than real estate, including shares of private Canadian corporations, partnership interests in Canadian partnerships, and capital interests in Canadian trusts. Form T2062 handles direct real estate sales only.

CRA processing takes 4 to 8 weeks for complete applications with accurate calculations and supporting documentation. Applications missing required documents, containing calculation errors, or involving complex treaty provisions require additional review time. Peak filing periods in spring and fall also extend processing.

Tax treaty exemptions eliminate the certificate requirement only when the disposition qualifies for complete treaty relief and CRA receives proper notification. Most residential property sales do not qualify for treaty exemptions, making the certificate mandatory regardless of your country of residence.

Late filings result in penalties of $25 per day up to a maximum of $2,500. CRA may also delay certificate issuance and your lawyer continues holding sale proceeds until the matter resolves.
